Se analizan los principios del DIH, los sujetos protegidos y las obligaciones del Estado colombiano conforme al derecho internacional y constitucional.El curso profundiza en el estudio de la jurisprudencia del Sistema Interamericano de Derechos Humanos, abordando la responsabilidad internacional del Estado, el deber de prevenir, investigar, sancionar y reparar, así como el control de convencionalidad. Se dedica un análisis especial al caso del exterminio de la Unión Patriótica, desde la actuación de la Comisión Interamericana de DDHH y los estándares internacionales aplicables.Asimismo, se estudia el marco normativo interno, en particular la Ley 1448 de 2011 (Ley de Víctimas y Restitución de Tierras), los derechos de las víctimas del conflicto armado y los mecanismos de justicia transicional, incluyendo la JEP y el Sistema Integral de Verdad, Justicia, Reparación y No Repetición.Este curso no aborda la historia del conflicto armado desde una perspectiva cronológica, sino que se centra en su análisis jurídico, permitiendo a los estudiantes desarrollar una comprensión crítica del conflicto colombiano desde los estándares de DDHH y DIH.
